Collaborative Law
For those couples who consider privacy a guiding issue as they proceed with divorce arrangements, collaborative law can offer a discreet resolution outside of the courts.
It’s also the best solution in cases where each party wants their attorney present during negotiations.
How it Works
Collaborative law helps separating and divorcing couples reach agreement respectfully, privately, and without going to court. The process is based on three principles:
- Voluntary and free disclosure of information by both spouses
- A pledge not to go to court, and withdrawal of both attorneys if either spouse goes to court
- A settlement that takes into account the highest priorities of both adults and their children
The goal of collaborative law is to find solutions which meet the needs of the family, and which allocate the family’s resources fairly.
What is the Role of an Attorney?
In this approach, each spouse is represented by an Attorney trained specifically in collaborative law. The couple and the Attorneys meet together in a series of meetings during which they:
- Identifying information to be gathered and exchanged
- Discussing their shared and individual goals for the future
- Create options for settlement
- Reach an agreement which becomes the terms of their divorce
As appropriate, the Attorneys may recommend using additional professionals, including Accountants, Mental-Health Professionals, or Financial Planners.
Benefits
The divorce process is often overwhelming, and eliminating court visits can help make it more manageable. An alternative for those who share the goal of finding a solution that suits all parties’ needs, it also offers a greater level of privacy than other divorce options. Note that success in the process is entirely dependent on both parties willingness to work together.
